No-Bid Justification Questions

This form is a tool to help you complete the No-Bid Justification questions in BuyWays. A No-Bid Justification is an exception to competitive procurement. It may only be used if one of the below conditions apply.

Considerations

Please choose one of the four considerations below and gather the supporting documents (quotes, emails, letters, etc.) to attach to your contract request. As a note, Amherst and Boston users should attach the approved DocuSign PowerForm to their request, while all other campuses should complete the NBJ directly in the contract request form in BuyWays.

Which consideration applies?

Consideration 1: No other reasonable alternative source exists that meets the requirements (sole source).

Consideration 2: After solicitation from several sources, no other reasonable alternative source exists that meets the requirements.Consideration 3: A public urgency for the requirement will not permit a delay resulting from the competitive solicitation.Consideration 4: The Federal awarding agency, or pass-through entity, specifically authorizes noncompetitive procurement in response to a written request from the non-Federal entity.

Why is this product/service required or needed?

Describe methods used and gather documentation substantiating the claim that there is a single supplier for the referenced goods or services.

List alternative suppliers that were evaluated to determine if they could meet the requirements.

Describe the public exigency or emergency requiring the need to use of non-competitive procurement.

Describe the efforts taken to ensure price competitiveness of supplier rates and reduction of risk in lieu of the use of competitive procurement.
